Terms of Use — CDL Practice
These Terms of Use (“Terms”) govern your use of the CDL Practice mobile application and related services (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and eligibility
CDL Practice helps you prepare for Class B and Class A CLP written tests with on-device practice questions, scored tests, and a timed exam simulator. General Knowledge practice is available without Pro access. Pro unlocks full endorsement banks and the exam simulator. The App is intended as a study aid only, not as an official DMV, FMCSA, or state licensing program. You must be able to form a binding contract in your jurisdiction and comply with applicable law. You are responsible for verifying all information against your state CDL handbook and official testing requirements.
CDL Practice is not affiliated with FMCSA, any state DMV, or a CDL school.
2. Your data and local storage
Study progress, starred questions, and test results are stored locally on your device as described in our Privacy Policy. You are responsible for backing up or retaining information you need. PaprikaTech is not responsible for loss of data caused by device failure, uninstalling the App, or failure to export progress elsewhere.
3. Pro access and purchases
General Knowledge practice and a free Air Brakes sample are available without Pro access. Pro access unlocks full endorsement question banks, the timed exam simulator, and related Pro features described in the App.
Pro access is available through CDL Practice Pro, a one-time in-app purchase processed through Apple’s App Store and validated via our purchase provider (RevenueCat). Pro access does not expire unless required by law or these Terms. Prices, refunds, and Restore Purchases are governed by Apple’s payment policies unless otherwise required by law.
4. Study content and test readiness
Question content is designed to reflect common CLP written-test topics, but state requirements vary and official exams may differ. Passing a practice or simulated exam in the App does not guarantee that you will pass an official state test. You should use the App together with your state CDL handbook and any training required in your jurisdiction. PaprikaTech does not guarantee that App content is complete, current, or aligned with every state’s latest regulations.
5. Acceptable use
You agree not to:
- Use the App for unlawful, harmful, or abusive purposes
- Attempt to reverse engineer, scrape, or redistribute question banks except as allowed by law
- Circumvent security, licensing, or Pro access requirements
- Use the App in ways that infringe others’ rights or violate applicable policies
- Represent the App as an official government or licensing product
6. Intellectual property
The App, branding, question banks, and materials provided by PaprikaTech are owned by PaprikaTech or its licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, revocable license to use the App for personal study purposes in accordance with these Terms and the App Store rules.
7. Privacy
Our Privacy Policy explains how we handle information. It is incorporated into these Terms by reference.
8. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. THE APP IS NOT A SUBSTITUTE FOR OFFICIAL DMV OR FMCSA MATERIALS, TRAINING, OR LICENSING DECISIONS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPRIKATECH AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING STUDY DECISIONS OR TEST OUTCOMES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
10. Indemnity
You agree to indemnify and hold PaprikaTech harmless from claims arising out of your misuse of the App, your violation of these Terms, or your violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
11. Changes
We may update these Terms or the App. We will post revised Terms with a new “Last updated” date. Continued use after changes constitutes acceptance. Material changes may also be communicated through the App or App Store listing where appropriate.
12. Termination
You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App or your access if you breach these Terms or if required for legal or safety reasons.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country or state of residence apply.
